The Client agrees that he/she is responsible for all parties involved with the agreed upon photo session. If there is an individual involved in the photo session who does not agree to the terms of this agreement the Client assumes responsibility for any liability.

PAYMENT ARRANGEMENT: The Client will pay the Photographer a deposit to secure the session. This deposit non-refundable. The balance of the session will be paid on the day the images are taken.

SESSION IMAGES: Images will be put onto an online gallery once they are finished where the client can download as they wish using a pin code provided for a minimum of 2 months. The Photographer cannot guarantee the digital gallery for any longer time period so it is essential for the client to download and back up themselves when the gallery link is sent. Photographs will be stored on a back up hard drive for as long as the photographer can keep them. Physical prints can take up to 12 weeks after the digital gallery is delivered, to be posted out to the client during busy periods.

CANCELLATION/POSTPONEMENT: The Client understands that by entering into this agreement, Photographer is foregoing other photographic jobs. In the event of a cancellation or postponement of the portrait session/agreement by Client, the monies paid to book are non-refundable but are transferable if a date change is necessary as long as 24 hours notice is given. If it is not possible for a session to take place on a scheduled day due to weather, or at the fault of the Photographer, the Photographer and the Client will reschedule on an agreed date at the earliest convieniance with no additional charge.

COOPERATION: Photographer’s camera is the only camera allowed at the photo session because of the distraction it causes, especially to small children, which hinders the Photographer’s ability to obtain quality shots, unless otherwise agreed with the Photographer.

DIGITAL IMAGES PRINTS & COPYRIGHT: All images and copyrights are the property of Ashley Canavan ("Photographer"). In exchange for services provided, the Photographer retains the exclusive right to edit and use for any reason, including but not limited to: Facebook advertising, website marketing, competitions and monetary gain.

All photos created by Photographer are copyright protected. It is a violation of copyright law to copy, scan, or allow photographs to be reprinted, duplicated, digitally reproduced, copied, scanned, used commercially or altered digitally or otherwise, without the Photographer's express written permission. The client may print (on their own) their personal photographs. Unathorised use can effect my livelihood and reputation and may also harm my ability to produce high-quality artwork in the future. All contents remain copyright of Portrait Atelier Ashley (Ashley Canavan). This license allows the client to do the following with the images: i) Display the images; ii) Print the images; iii) Upload, email, or electronically transfer the images or files; and, iv) Publish the images on personal websites or social media websites.

THIS LICENSE WILL PROHIBIT THE CLIENT FROM DOING THE FOLLOWING: APPLYING FOR COPYRIGHT OR SELLING OF ANY IMAGE OR ELECTRONIC FILES SUPPLIED BY PHOTOGRAPHER MAKING ‘DERIVATIVE WORKS’ OR OTHERWISE MODIFY, INCLUDING EDITING AND/OR MANIPULATING ELECTRONIC FILES

EXHIBITION: Client grants Photographer permission to display selected images resulting from this assignment as an example of Photographer’s work.

LIMIT OF LIABILITY: In the unlikely event that all the originals are lost, stolen, damaged or destroyed within or beyond the Photographer’s control, the Photographer’s liability is limited to the refund of all payments received, or a reshoot that can be scheduled at no additional cost. In the unlikely event that the Photographer is injured or becomes too ill to attend the portrait session, the Photographer will make every effort to reschedule to the earliest possible date.

MODEL RELEASE: For valuable consideration received, he client grants Portrait Atelier Ashley (Ashley Canavan) full permission concerning any images that she has taken or may take to use, publish, and republish the photographs and grants the Photographer the right to use the images for advertising including any form of social media, competition, print or website unless discussed otherwise during the session.

The creation of your images involves experience, vision, skill, effort and artistry to the highest possible level.

Under no circumstances should any of these images be used comercially without Portrait Atelier Ashley's written consent. The photographs are NOT ALLOWED to be edited in ANY way, shape or form (this includes socal media filters or turning into black and white).

The undersigned have read and understood the contract and agree to the terms and conditions.
